Ex-vereador de Brotas é condenado por extorsão
Fernando José Bissoli foi acusado de ter exigido, indevidamente, R$ 11.850 de um secretário municipal
Decisão da 12ª Câmara de Direito Criminal do Tribunal de Justiça de São Paulo manteve decisão que condenou o ex-vereador de Brotas, Fernando José Bissoli, a dois anos de reclusão, em regime inicial aberto, e ao pagamento de dez dias-multa pelo crime de concussão.
A pena foi convertida em pagamento de meio salário mínimo por mês, por dois anos, e interdição temporária de direitos constante na proibição do exercício de cargo, função ou atividade pública.
Em denúncia, ele foi acusado de ter exigido, indevidamente, R$ 11.850 de um secretário municipal para votar contra pedido de cassação do prefeito Antônio Benedito Salla, em sessão da Câmara Municipal. O secretário gravou a conversa e comunicou o fato ao delegado de polícia, que prendeu o ex-vereador em flagrante após ele ter recebido parte da quantia.
Segundo o relator Amable Lopez Soto, a autoria e materialidade do crime estão devidamente comprovadas nos autos. “Todas as circunstâncias expostas constituem elementos de convicção mais que suficientes para a formação de um juízo de certeza acerca da autoria do crime por parte do réu, de sorte que não há lugar para a pleiteada absolvição.”
Os desembargadores Angélica de Maria Mello de Almeida e Paulo Antonio Rossi também participaram do julgamento, que teve votação unânime.
