Justiça julga improcedente ação civil pública contra ex-prefeito
Juiz entendeu que não houve má fé no pagamento das parcelas do Fundeb a ex-diretora de Educação

A ação civil pública movida pelo Ministério Público contra o ex-prefeito Paulo Antonio Gobato Veiga, a ex-diretora de Educação, Regiane Pagani Serra dos Reis, e do advogado Adelino Morelli, alegando recebimento indevido de recursos do Fundo de Manutenção e Desenvolvimento da Educação Básica e de Valorização dos Profissionais da Educação (Fundeb) por Regiane, foi julgada improcedente pela Justiça de Ribeirão Bonito.
A Justiça de Ribeirão Bonito entendeu que não houve má fé no pagamento das parcelas do Fundeb a ex-diretora de educação. “Todavia, a este juízo, após a instrução, resultou a convicção de que o ressarcimento não é devido, pois não foi comprovada a má-fé ou culpa de qualquer dos réus, já que o parecer de Adelino está suficientemente embasado e motivado a decisão de Paulo tem amparo no parecer e na circunstância de que Regiane, de fato e efetivamente, participava essencialmente atividades ligadas à Educação não foi produzida qualquer prova de conluio, má-fé ou culpa de tais agentes”, destacou na sentença o Excelentíssimo Juiz Dr. Rafael Pinheiro Guarisco.
O advogado do ex-prefeito, Luís Donizetti Luppi, mostrou, durante o processo, que Paulo Veiga agiu de boa fé e com base em parecer do advogado da Prefeitura, sendo assim não ter cometido nenhuma ilegalidade, tanto que ficou reconhecido e provado na sentença que Regiane, então Diretora de Educação, também atuava no planejamento, nas atividades e, especialmente, nas orientações pedagógicas. “Toda a tese defensiva foi nessa linhas, ou seja, demonstrar e provar não ter havido vantagem a ninguém. As testemunhas ouvidas provaram que Paulo Veiga era e sempre foi criterioso, nunca assinando um documento sem antes questioná-lo com o funcionário ou com o Departamento Jurídico da Prefeitura”,observou Luppi.
A sentença foi dada na segunda-feira (17). O Ministério Público pode recorrer da decisão.

clearing my mind in getting my ideas out.
I do take pleasure in writing but it just seems
like the first 10 to 15 minutes tend to be wasted simply just trying to figure out how to
