Prefeito de Ribeirão Bonito é multado pelo TCE
Nenê Forte terá que pagar 160 UFESP´s, equivalente a R$ 3.097,60

O prefeito de Ribeirão Bonito Wilson Forte Junior (PMDB), Nenê Forte, foi multado pelo Tribunal de Contas do Estado (TCE) em virtude de haver entregue fora do prazo os documentos, descumprindo assim as Instruções de Comunicados e Resoluções nº06/12.
Mesmo após a apresentação de justificativas, as mesmas foram consideradas insuficientes elidindo em reincidência no Cadastro Eletrônico de Obras em Execução 2013, onde a data limite de remessa era 30 de julho de 2013 e foi enviada ao TCE em 27 de agosto de 2013, posterior a notificação supracitada.
Portanto de acordo com a publicação, “nos termos do inciso VI, do artigo 104, da Lei Complementar nº 709/93, foi aplicada multa ao Senhor Wilson Forte Júnior, Prefeito Municipal de Ribeirão Bonito, no valor pecuniário correspondente a 160 Unidades Fiscais do Estado de São Paulo (UFESP’s)”, que equivalem a R$3.097,60, “devendo a correspondente Guia de Recolhimento junto ao Fundo Especial de Despesa deste Tribunal, ser apresentada em 30 dias, contados após o transcurso do prazo recursal, sob pena de inscrição no Sistema de Dívida Ativa”.
A determinação foi publicada no Diário Oficial do Estado no dia 15 de outubro de 2013.
Qual a mentira desta matéria agora? Ah já sei, o jornalista inventou a publicação no diário oficial, foi isso né, pode confessar Lucas.
Só uma pergunta: é o Prefeito quem deve ter em mente “TODOS” os prazos e as datas-limite de entrega de documentos? Ele governa sozinho? É claro que ele tem de responder por tudo o que acontece, mas multar “O Prefeito” e não “A prefeitura” me parece um tanto estranho!

Eu também queria entender, mas a publicação deixa claro que a multa vai para o prefeito. Acho, no meu entender, que a multa deveria ser distribuída a toda equipe, no caso a Prefeitura, mas é o que está escrito no Diário Oficial.

Certo Paulo, mas quem paga a multa é o prefeito e não a prefeitura. O dinheiro para quitar a multa sai do bolso do prefeito, portanto o multado é ele.
Por isso no comentário acima disse que no meu entender a multa deveria ser distribuída a toda equipe, no caso a prefeitura e não apenas só ao prefeito.

Acredito que não deveria, visto que o Tribunal de Contas dispõe de todas as informações em relação ao processo citado, até porque o processo é publico, mas estou me dispondo esclarecer o comentário onde é mencionado que a multa aplicada ao Sr. Prefeito ocorreu por algum advogado ou advogada ter perdido prazo. O TCE tem um cronograma para entrega e remessa de informações administrativas, e a multa foi aplicada porque este alega não ter recebido tais INFORMAÇÕES (aqui não se trata de prazo de defesa), que foram entregues.Foi feito recurso(agora sim é defesa, feita por esta que ora os esclarece) em razão da aplicação de multa.
Será que fui clara?????!!!!
