O motorista suspeito de causar um acidente que tirou a vida de uma gestante de oito meses e do marido dela, na madrugada de domingo (5), na Rodovia Luís Augusto de Oliveira (SP-215), entre São Carlos e Ribeirão Bonito, pode ser solto ainda nesta segunda-feira (6). Isso porque a família pagou a fiança arbitrada pelo juiz em 15 salários mínimos, o equivalente a R$ 10,8 mil. Tiago Scapim foi preso em flagrante depois que o teste do bafômetro confirmou a presença de álcool no sangue.
“O juiz considerou que ele é réu primário, não ostenta antecedentes criminais, possui residência fixa e atividade profissional lícita, então arbitrou a fiança”, explicou o advogado do rapaz, David Pires. Em princípio, o caso deve ir a júri popular.
Mortes – O acidente aconteceu por volta das 3h30 de domingo na SP-215. Segundo a Polícia Militar, o engenheiro de 30 anos dirigia um Prisma sentido São Carlos quando invadiu a pista contrária e atingiu o Gol. O amigo dele, que viajava como passageiro, e a gestante, sentada no banco de trás, morreram na hora. O filho do casal estava preso a uma cadeirinha e sofreu apenas um arranhão no rosto.
Ainda segundo a PM, o motorista do Prisma apresentava sinais de embriaguez. Ele foi preso em flagrante após realizar o exame de bafômetro e responderá por lesão corporal, embriaguez ao volante e homicídio doloso, quando há intenção de matar. O advogado dele nega a embriaguez. “Tinha sim presença de álcool no sangue, mas isso não quer dizer que ele estava embriagado. Ele estava consciente de suas atitudes”, falou.
Farol alto – Segundo Pires, o engenheiro foi confundido pelo farol alto de outro veículo na pista. “Ele viu aquele clarão e achou que estivesse na mesma faixa que ele e na confusão, ele acabou puxando o volante para a esquerda”, justificou.
O advogado defende que o engenheiro tem direito a aguardar em liberdade até que o caso seja julgado. “Ele é trabalhador, não tem antecedentes criminais. Ele não tem nem multa de trânsito. Trabalha há 13 anos na mesma empresa e nunca teve queixa. O caso é um homicídio simples”, alegou.
O engenheiro foi transferido para o Centro de Detenção Provisória de Araraquara nesta segunda-feira (6).
