Na tarde desta sexta-feira o deputado também visitou o jornal Folha de S.Paulo para tratar do tema.
“Desde o início eu sabia que o tema era polêmico, mas era preciso enfrentá-lo, só no Brasil essa excrescência autoritária foi introduzida pelo Código Civil, em 2002, ferindo frontalmente a Constituição”, esclarece. Pela proposta do deputado, livros e filmes biográficos de pessoas famosas não precisam de autorização prévia do biografado ou de sua família.
Para o parlamentar, o que está em jogo é o fim da censura, independente da discussão que vem sendo travada por alguns parlamentares e por algumas celebridades sobre a garantia à privacidade. “A Constituição garante o direito à honra e à imagem de qualquer cidadão, inclusive da celebridade”, destaca. “Cantores, atores, jogadores de futebol e outros artistas ditam moda, ditam comportamento, portanto são pessoas públicas, que tem o direito à privacidade diminuído em relação à pessoa comum porque ganham a vida, honestamente a partir do seu talento, por serem pessoas públicas, além de interferirem no dia a dia da história da humanidade”, explica.
De acordo com Newton Lima, o artigo 20 do Código Civil como está escrito impede que parte da história do Brasil seja contada. “São os biógrafos que, ao escreverem as biografias nas suas mais variadas versões, contam a história da humanidade. Impedir as biografias não autorizadas é cortar a produção do conhecimento, a liberdade de expressão e a liberdade de escrever ou falar sobre qualquer pessoa”, finaliza.
