Newton Lima diz no STF que “é preciso impedir que se estabeleça a censura prévia”

O deputado federal Newton Lima (PT-SP), autor do projeto de lei que proíbe a censura prévia a biografias de pessoas públicas, participou nesta quinta-feira (21) de audiência pública no Supremo Tribunal Federal (STF), para discutir o tema. “É preciso impedir que se estabeleça a censura prévia”, afirmou o deputado, durante sua defesa.
O STF analisa uma Ação Direta de Inconstitucionalidade (Adin), ajuizada pela Associação Nacional dos Editores de Livros, que também quer o fim da censura prévia para biografias de pessoas públicas. Dos 17 convocados pela ministra Cármen Lúcia para a apresentação de posições sobre o tema, a maioria, 14, posicionou-se a favor da publicação sem censura e, apenas três foram contra.
Na avaliação de Newton Lima, a iniciativa busca afastar “resquícios legais da censura, ainda presente no artigo 20 do Código Civil, e evitar o cerceamento do direito de informação, tão caro aos brasileiros, após anos de ditadura”. Para ele, os direitos privados de uma pessoa pública são relativizados, “devendo a pessoa arcar com o bônus e o ônus de ser uma pessoa pública”.
Newton Lima citou como exemplo do que classifica de “restrição ao acesso à informação”, a proibição do documentário “Di”, de Glauber Rocha, em homenagem ao pintor Di Cavalcanti, e lembrou casos de condenações de editoras e biógrafos que publicaram biografias não autorizadas de cantores, jogadores de futebol e poetas.
O deputado ressaltou que a não exigência de autorização para publicação de obra biográfica não significa atentado à dignidade da pessoa humana e que em outros países os interesses da coletividade em ter acesso às informações são garantidos independentemente de autorização.
Projeto de Lei 393/2011 – O projeto de Newton Lima, mais conhecido como Lei das Biografias, deve ser votado em dezembro. O parlamentar explica que o PL pede a modificação dos artigos 20 e 21 do Código Civil – que prevê autorização prévia do biografado ou de sua família para a divulgação de imagens, escritos e informações biográficas –, vai ganhar novo parágrafo para garantir rapidez na Justiça em caso de informações falsas ou ofensivas.
“A ideia é que possamos reparar eventuais crimes com celeridade. O Juizado Especial, previsto na lei 9099/95, também vai permitir acordos e o juiz especial vai procurar as duas partes e resolver”, explicou.
