O título deste artigo parece inusitado para um texto relacionado à Administração, porém representa o atual estado de desumanidade pelo qual estão passando milhões de moradores na Região Metropolitana do Rio de Janeiro e na Baixada Santista.
É sabido que o verão em regiões como os litorais paulista e fluminense gera um aumento de demanda no consumo dessa substância composta por átomos de hidrogênio e oxigênio. Isso se deve, principalmente, ao crescimento sazonal da população nessas áreas e à elevação das temperaturas. No caso da cidade do Rio de Janeiro, é comum os termômetros registrarem nesta época do ano valores superiores a 40°C, isso sem falar na sensação térmica que supera facilmente os 50°C.
O que é intolerável, e que reflete a falta de planejamento do Poder Público e das concessionárias responsáveis pelo abastecimento de água nas regiões supracitadas, é a escalada do desrespeito ao consumidor-cidadão a cada verão que se sucede: na Cidade Maravilhosa, o desabastecimento é tamanho que 2014 chegou e a água em algumas localidades, não. Isso se verifica, sobretudo, nosubúrbio carioca.
Não obstante o desrespeito praticado pela CEDAE (RJ) e pela SABESP (SP) em relação à ausência de prestação de serviço adequada, conforme preceitua o § 1° do art. 6° da Lei n° 8.987/1995, observa-se uma quebra de contrato por essas empresas, sujeitando-as ao disposto no art. 56 da Lei n° 8.078/1990 (Código de Defesa do Consumidor). Dessa forma, o cidadão que se sentir lesado sob os aspectos moral e material pode acionar os órgãos de proteção ao consumidor ou o Poder Judiciário. No Rio de Janeiro, uma outra opção é acionar o Ministério Público estadual (MPRJ) pela sua Ouvidoria (telefone 127 ou endereço eletrônico http://www.mprj.mp.br/cidadao/ouvidoria/). Afinal de contas, O Ministério Público está incumbido da defesa da ordem jurídica, do regime democrático e dos interesses sociais e individuais indisponíveis, dentre os quais, aqueles relacionados à prestação adequada de serviços públicos.
Por fim, há que se lamentar tais eventos, que evidenciam a existência de problemas estruturais que nenhuma maquiagem urbanística e/ou ação publicitária é capaz de mitigar no principal eixo econômico nacional: a falta de planejamento do desenvolvimento econômico-social. Convenhamos que “pega muito mal” para dois dos principais motores da economia brasileira aparecerem nos noticiários não por sua opulência, mas pela precariedade de seus serviços públicos essenciais, e isso em pleno ano de Copa do Mundo em nosso país. Registre-se aqui um ensinamento popular que deve servir de lição para governos e sociedade neste momento: jamais se deve tirar dos seus para dar aos outros. Portanto, antes de empregarmos recursos públicos para manter o país “bem na foto” com o mundo, construindo arenas esportivas com padrão FIFA, não nos esqueçamos do nosso próprio bem-estar, pois a dignidade da pessoa humana é um dos princípios fundamentais da República Federativa do Brasil.
