O Tribunal Regional Eleitoral de São Paulo (TRE-SP) deve julgar nesta terça-feira (5) o recurso da prefeita eleita de Ibaté, Lu Spilla (PSDB), contra a impugnação da sua candidatura.
A prefeita eleita, pela maioria da população, concorreu ao pleito com uma liminar concedida pela desembargadora Diva Malerbi, contra a decisão do indeferimento do registro de sua candidatura, dado pelo juiz eleitoral Milton Coutinho Gordo, do Cartório Eleitoral de São Carlos, o qual entendeu que a condição de inegibilidade do ex-prefeito José Luiz Parella, o Zé Parella (PSDB), se estende à prefeita eleita, por ela ser sua namorada. “Permitir o registro por ela (Lu Spilla) solicitado é o mesmo que admitir o terceiro mandato pelo mesmo cidadão, ou ainda, a permanência de sua família no mesmo cargo do Poder Executivo, ou, pior, a ‘dinastização’ sustentada pelo Ministério Público Eleitoral”, afirmou.
O julgamento que estava marcado para acontecer no dia 29 de novembro, foi adiado devido um problema de saúde de uma desembargadora. Hoje, o TRE deve analisar o mérito do processo, de iniciativa do Ministério Público Eleitoral e acolhido pela Justiça Eleitoral local.
Lu Spilla e seu vice Nicola (PMDB) foram diplomados na manhã do ultimo dia 30, na semana passada. A cerimônia não foi aberta à imprensa e ocorreu no Cartório Eleitoral de São Carlos, sendo presidida pelo juiz da 410ª. Zona Eleitoral de Ibaté, Milton Coutinho Gordo. A posse será no próximo dia 8 (sexta-feira).
Se for mantida a procedência pela união estável entre Lu e Zé Parrela, o resultado da eleição deverá ser alterado. Daí, existem duas possibilidades: a anulação da candidatura de Lu Spilla e a declaração da vitória de Júnior Trevisan (PTB) como candidato único que teria disputado o pleito de 6 de outubro e a segunda possibilidade é a realização de uma nova eleição. Além disso, caso perca o recurso, Lu também poderá recorrer ao TSE (Tribunal Superior Eleitoral), em Brasília.
Lu Spilla foi eleita com 9.660 votos (52,32%), contra 8.802 (47,68%), do seu concorrente Júnior Trevisan (PTB).
